OZN OLYMPIAN K9 – TERMS & CONDITIONS AND LIABILITY WAIVER

1. BINDING AGREEMENT

By utilizing the website, booking a consultation, or purchasing any canine training, boarding, or evaluation services from OZN Olympian K9, the client (hereafter referred to as "Client") agrees to be legally bound by these Terms & Conditions. 

2. PAYMENT, CANCELLATIONS, AND REFUNDS

• No Refunds: All payments made to OZN Olympian K9 for private sessions, behavior modification packages, and board-and-train programs are strictly non-refundable.
• Cancellation Policy: Client must provide at least 24 hours' notice to reschedule a private session. Failure to provide 24 hours' notice will result in the forfeiture of that session from the client's package.
• Package Expiration: All prepaid training packages must be utilized within six (6) months of the purchase date. Unused sessions after six months will expire with no financial credit or refund given.

3. CLIENT ASSUMPTION OF INHERENT RISKS

Client acknowledges and agrees that dog training, socialization, and behavior modification involve inherent risks of physical injury, property damage, or unpredictable canine behavioral shifts. Client explicitly assumes all risks associated with participation in training sessions, whether conducted at the Client's home, public spaces, or an OZN Olympian K9 designated facility.

4. FULL DISCLOSURE REQUIREMENT

Client agrees to provide a truthful, accurate behavioral history for their dog, including any past incidents of aggression, lunging, barking, resource guarding, or biting toward humans or other animals. Failure to disclose a known history of aggression gives OZN Olympian K9 the right to immediately terminate training services without a refund.

5. INDEMNIFICATION AND LIMITATION OF LIABILITY

• Hold Harmless: Client agrees to indemnify, defend, and hold completely harmless OZN Olympian K9, its owners, trainers, and handlers from any and all legal claims, lawsuits, damages, or financial losses (including legal fees) arising from injuries or property damage caused by the Client's dog during or after the training period.
• Third-Party Liability: Client assumes full legal and financial responsibility for the actions of their dog at all times. OZN Olympian K9 shall not be held liable for any damages or injuries sustained by the dog, the Client, or any third party. 
• Veterinarian Authorization & Medical Emergencies: By leaving an animal in the care of OZN Olympian K9 (for boarding, day-care, or board and train programs) the Client authorizes the Trainer to seek emergency veterinary care at the Client’s sole expense if the dog becomes ill or injured. OZN Olympian K9 will make reasonable attempts to contact the owner first, but retains fI’ll authority to authorize life-saving treatment as directed by a licensed veterinarian. The Client agrees to reimburse OZN Olympian K9 in full for all veterinary costs upon pickup.
• Abandonment Policy: If a dog is not picked up within five (5) calendar days of the scheduled completion date, and the Client fails to maintain direct communication or make financial arrangements, the dog will be legally considered abandoned. OZN Olympian K9 retains the right to rehome, transfer or surrender the animal in accordance with North Carolina law, and the client remains fully liable for all outstanding training, boarding and legal fees. 

6. NO GUARANTEE OF SPECIFIC RESULTS

Client acknowledges that canine behavior is fundamentally influenced by genetics, environmental factors, and the Client’s personal training consistency outside of structured lessons. While OZN Olympian K9 delivers professional, proven handling methodologies, the business makes no absolute warranties or guarantees regarding the permanent modification of any dog's behavior.

7. THE BREEDING & PROSPECT SALES CLAUSE

• Holding Deposits: All deposits placed to reserve a puppy from a current or future litter are strictly non-refundable. Deposits serve as a guarantee of intent to purchase and take the puppy off the market. If a buyer backs out, fails to execute the final contract, or misses the pickup deadline, the deposit is completely forfeited to OZN Olympian K9 as liquidated damages. Current accidental crossbred prospects are sold under a strict “As-Is” contract with no health, orthopedic or environmental warranties. Future, intentional purebred litters will be executed under distinct, comprehensive breed-specific genetic health contracts provided directly to approved buyers.
• No Right To Breed/ Spay Neuter (If applicable): All prospects sold by OZN Olympian K9 are subject to individual contract restrictions regarding breeding rights. Unless explicit “Full Registration and Breeding Rights” and documented in a signed contract, all puppies are sold as performance/companion prospects ONLY. Unauthorized breeding of an animal produced by OZN Olympian K9, constitutes a breach of contract, resulting in immediate liquidation damages and the potential repossession of the animal. 

8. GOVERNING LAW

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of North Carolina. Any legal disputes arising under this agreement must be filed in the courts of North Carolina.
